What is Mediation?​​​

Mediation is a voluntary and cooperative process in which two or more parties involved in a dispute work with an impartial party, the mediator, to generate their own solutions in settling their conflict.​

This process allows you to maintain control of your lives, keep your dignity and respect in the process.
Unlike a judge or an arbitrator whose decisions often subject one party to win and the other party to lose, mediation is about finding a solution that works for both parties.​​​​

Any conflict can be mediated. No topic is too big or too small to resolve through the mediation process.

What is the role of the Mediator?

The mediator’s role is to facilitate communication between the parties and offer suggestions without imposing solutions. Mediators do not advise independently, take sides or render a judgment. Instead, the mediator will work with all the parties to help them reach a mutually acceptable resolution.  The mediator is a neutral and impartial guide to help you come up with possible solutions, stay on track, and clarify areas of agreement and disagreement.  The mediator may help you and the other party see the conflict from each other side’s point of view.

What Does Mediation Cost?

Mediation is a highly cost effective alternative to litigation which may continue for months or even years, instead of days. Mediation saves time, money, energy and can dramatically reduce stress.

Family Focus Mediation charges $125/hour/party ($250/hour total) with a two hour minimum plus a $100 administration fee for all of the forms and paperwork that must be handled, culminating with the final Settlement Agreement which must be signed by all parties and submitted to the court.  We offer a free consultation to explain our services and benefits, as well as provide a written cost estimate based on the specifics of your situation, prior to commencement of the mediation. 

 

How long does a mediation last?

Mediation may range from a few hours to a day or several days, depending on the complexity of the case or number of parties in the dispute.

We strive to reach a mediation agreement within a day or less, but it is possible that some mediations may take longer.

 

Is Mediation Right for Us?

Mediation works for most couples. Whether you need to start from the beginning or just need to settle those last few details, mediation can provide a safe, cost effective, and most often quicker alternative to litigation. However, if one spouse is in physical danger or unwilling to participate then mediation would not be the right process.  

 

What happens if I don't come to any agreement in mediation?

If you are court ordered to mediation and you are unable to settle your differences, you will go back to court and the judge (or jury) will make a decision for you.

What are some advantages to mediation?

  1. Mediation provides an opportunity to talk with someone who is impartial.  

  2. The issues in your dispute are not decided by someone else (self-determination).

  3. What you say in mediation is confidential.

  4. The mediator can help you overcome obstacles to communication with the other person or party in your dispute.

  7. Mediation is not a trial nor an arbitration.

  8. Mediation can save time and costs.

  9. You know what you have agreed to in mediation instead of gambling with what the judge or jury may decide if you go to court.

  10. Mediation is an opportunity to gain a greater understanding about why the dispute arose.
